Privacy Notice

Provided on this page is the information required - pursuant to article 13 of Legislative Decree no. 196 of 30 June 2003, the “Personal Data Protection Act” (‘hereinafter “Data Protection Act”) and article 13 of EU Regulation no. 2016/679, concerning the provisions that protect individuals with regard to personal data processing and the free movement of such data (hereinafter also referred to simply as “Regulation”) - regarding the processing of the personal data of users who make a registration to the  “Download Area” and sign up for the newsletter service of Minotti S.p.A. (hereinafter also referred to simply as the “User” or collectively as the “Users”) of the minotti.com website (hereinafter also referred to simply as the “Website”), respectively, to create their own account and have access to information and materials available on the Website and to receive via e-mail, automatically and free of charge, each new issue of the newsletter, which also includes information of a commercial and promotional nature.

  2. Category of personal data processed. The personal data provided directly by the Users when they (i) make a registration to the “Download Area” creating their own account and (ii) sign up for the newsletter.
  3. Purposes of personal data processing. Your personal data voluntarily provided will be processed by the Data Controller (i) for managing and elaborate the registration to the Download Area and (ii) for marketing purposes, and specifically for managing the registration process and the periodic sending of Minotti newsletters, and for sending information, commercial and/or promotional communications via e-mail.
  4. Legal basis. The legal basis for the processing of personal data for the purposes referred to above is the User's explicit prior consent.
  5. Nature of the processing. The provision of personal data by the User for the purposes set forth in paragraph 3 is optional, but failure to provide said data would make it impossible to (i) create a User account in the Download Area and (ii) complete the newsletter registration process.
  6. Means of data processing. Personal data will be processed lawfully, correctly and in a transparent manner, for specific, explicit and legitimate purposes and in compliance with the laws, regulations and provisions regarding personal data protection.

Users’ personal data will be processed primarily in electronic format and in some cases also in hardcopy format.

The personal data you have provided will not be subject to fully automated decision-making processes.

  1. Recipients of personal data. The recipients of your personal data will be: a) employees and/or collaborators of Minotti (e.g. marketing dpt., PR dpt., graphic dpt.), who have received specific written instructions; b) subjects that provide services to Minotti, appointed in writing as data processors by the latter; c) subjects that provide services to Minotti as independent data controllers (legal, fiscal and accounting consultants), public authorities in the event of fiscal and financial audits. Your data will not be disseminated. In any case, your data will be processed with the most adequate measures to preserve their security. For a complete and updated list of the recipients of personal data, Users may write to Minotti at the addresses indicated below.
  2. Term of personal data storage. Users’ personal data for the purposes set forth in paragraph 3 will be stored for 5 years from the date they are provided.
  3. Transfer of personal data outside of the EU. Your personal data will not be transferred outside the European Union.
  4. Exercising the rights of the data subject. The User, acting as a data subject in the processing of Personal Data (the “Data Subject”), may exercise the rights provided for in the Regulation, towards Minotti, with regard to the processing activities concerning your Personal Data.

In particular, the Data Subject has:

  1. the right of access (Article 15 of the Regulation). The Data Subject may obtain confirmation as to whether or not Personal Data relating to him/her are being processed, as well as access to information on the purposes of the processing, the categories of Personal Data being processed, the recipients or categories of recipient to whom the Personal Data are or will be disclosed, the storage period envisaged, the existence of the right to request rectification, erasure or restriction of processing, the right to lodge a complaint with a supervisory authority, the existence of an automated decision-making process, including profiling;
  2. the right to rectification (Article 16 of the Regulation). The Data Subject may obtain the rectification of inaccurate Personal Data concerning him/her, or the Data Subject may have incomplete Personal Data completed;
  3. the right to erasure (‘right to be forgotten’) (Article 17 of the Regulation). The Data Subject may obtain the erasure of Personal Data concerning him/her, if:

i. the Data Subject withdraws the consent given for the processing of Personal Data;

ii. the Personal Data are no longer necessary for the purposes for which it was collected;

iii. the Personal Data have been unlawfully processed;

iv. for compliance with a legal obligation, the Personal Data must be erased;

  1. the right to restriction of processing (Article 18 of the Regulation). The Data Subject has the right to obtain the restriction of the processing of Personal Data concerning him/her if:

i. the accuracy of the Personal Data is contested by the Data Subject, for a period enabling the Controller to verify the accuracy of the Personal Data;

ii. the processing is unlawful and the Data Subject opposes the erasure of the Personal Data and requests the restriction of their use instead;

iii. Minotti no longer needs the Personal Data for the purposes of the processing, but they are required by the Data Subject for the establishment, exercise or defence of legal claims;

iv. for the time necessary to assess the possible prevalence of the legitimate grounds of the Controller over those of the User, the User has opposed the processing of his/her personal data pursuant to point c which follows;

  1. the right to data portability (Article 20 of the Regulation). The Data Subject has the right to receive the Personal Data concerning him or her provided to the Controller, in a structured, commonly used and machine-readable format, and has the right to transmit such data to another Controller without hindrance by Minotti, if the processing is carried out by automated means. If technically feasible, the Data Subject is also entitled to have his/her Personal Data transmitted directly from Minotti to another Controller;
  2. the right to object (Article 21 of the Regulation). The Data Subject has the right to object at any time to the processing of Personal Data concerning him or her if such processing is carried out pursuant to Article 6.1 letter e) (i.e. for the performance of a task carried out for reasons of public interest to which the Controller is subject) or letter f) (i.e. to prosecute a legitimate interest of the Controller) of the Regulation, unless there are compelling legitimate reasons for the Controller to proceed with the processing which override the interests, rights and freedoms of the Data Subject or for the establishment, exercise or defence of legal claims;
  3. the right to withdraw at any time the consent given where given without prejudice to the lawfulness of the processing of the User’s Personal Data based on consent given before the withdrawal;
  4. if he or she is not satisfied with the processing of his or her Personal Data carried out by Minotti, the right to lodge a complaint with the Data Protection Supervisor, following the procedures and indications published on the official website of said authority (www.garanteprivacy.it);

Any rectification or erasure of the User’s Personal Data or restriction of processing carried out at the User's request - unless this proves impossible or involves a disproportionate effort - will be communicated by Minotti to each of the Recipients to whom the User's Personal Data may have been transmitted in accordance with this Informative Notice.

The exercise of the above rights is not subject to any formal constraint and is free of charge. Minotti may only require the User to verify his or her identity before taking further action following the User's request.
